Military orders and your car lease: ending it early under the SCRA
If you signed a car lease and then got orders, federal law may let you end the lease early without the usual penalty. The steps are specific, and the timing matters.

The law in one paragraph
The Servicemembers Civil Relief Act, in section 3955 of title 50 of the U.S. Code, lets certain servicemembers terminate a motor vehicle lease early. It prohibits the lessor from imposing an early termination charge. This guide summarizes the rule in plain English. It is general information, not legal advice, and a legal assistance office on your installation can review your specific lease.
Who can use it
The vehicle-lease provisions cover several situations. The statute's wording controls, but in short:
- You signed the lease, then entered military service under a call or order for at least 180 days.
- You were already in service when you signed, and then received orders for a permanent change of station from the continental United States to a location outside it, or from a non-continental state to somewhere outside that state.
- You received orders to deploy for at least 180 days, either with a unit or as an individual supporting a military operation.
- You signed after receiving PCS or deployment orders, and then received a stop-movement order in response to an emergency, lasting indefinitely or at least 30 days, that prevents you from using the vehicle for personal or business transportation.
The statute has further protections for a surviving spouse or dependent, within one year after a servicemember dies in service or during certain Guard or Reserve duty, and for a servicemember with a catastrophic injury or illness within one year of the injury.
The steps
- Give written notice. Deliver written notice of termination to the lessor, its grantee or its agent, along with a copy of your military orders.
- Choose a delivery method that proves it arrived. The statute accepts hand delivery, a private business carrier, certified mail with return receipt requested, or electronic means likely to ensure actual receipt.
- Return the vehicle within 15 days after the notice is delivered.
- Keep records. Save the notice, the proof of delivery, the orders and the return paperwork.
Termination takes effect on the day both the notice and the vehicle return have happened, so a late return delays it.
What you do and do not owe
| Item | After a qualifying termination |
|---|---|
| Early termination charge | Not allowed |
| Lease payments before the termination date | Prorated for the period before it |
| Taxes, title and registration fees due | Still owed |
| Excess wear, use or mileage | Reasonable charges may still apply |
| Amounts prepaid for after the termination date | Refundable within 30 days of that date |
What to watch for
- A lessor may ask a court, before the termination date in your notice, to modify the protections as justice and equity require.
- The statute makes it a federal offense to knowingly hold a servicemember's or dependent's property or security deposit after a lawful termination in order to collect rent accruing after it.
- If a lessor refuses a qualifying termination or does not refund prepaid amounts, a base legal assistance office or the Department of Justice's servicemember resources are the places to start.
Before you sign a new lease
If you expect orders in the next year, tell the person writing your lease and ask how termination under the SCRA would work with that bank, in writing. The federal protection exists whether or not it is mentioned in the contract, but knowing the bank's process ahead of time saves days when the notice clock is running.
